Description of the job
Mission: Support Commodity Management / Buyer in the negotiation and contract signature procedures through administrative or direct implication. Manage and guarantee the definition and implementation of the procurement contractual policy, considering the inputs and results provided by the Commodity Manager, as well as the Legal department, Finance, Insurance and Export and the applicable rules. Guarantee the relevance, quality and consistence of the contracts.
Inputs: selling contracts, contracts database, purchasing contracts, legislation and national and international regulations.
Outputs: Ready-to-use availability, state of the art of the contracts for the Buyers, legislation evolution analysis, Company’s requirements in standard contracts, deals conclusion according to the Company’s requirements. Contractual key content identification for top management, review/validation, clarification, dispute avoidance, ensuring the uninterrupted operation of the business, contribute in the use of knowledge, enabling the support functions in order to achieve their objectives, contribute to the management of the knowledge of the company and the personal development.
New standard contracts drafting integrating the relevant requirements (economical, commercial, technological, juridical, risks…). Revision, optimization and development of existing contracts. Negotiation preparation, contract wording and execution of the negotiation output in support of the buyers for each commodity. Existing contractual documents evolution: i.e. complex amendments or extrajudicial agreements preparation, drafting and negotiation throughout the lifecycle of the contract. Support the signature of the validation of the contract. Contractual analysis of the agreements during the administrative phase, preventing future disputes or disagreements between the enterprise and the suppliers. Specialized non-contractual related analysis, drafting and design skills (except for aircraft sales). Assessment in relation to contractual implications in internal transversal projects. New Procurement Academy trainings development, as well as coaching and training-on-the-job junior buyers in the contracts and negotiation areas.
